Zoning Ordinance Update Project County and Fort Wayne technical amendments...

We are sending this to let you know about upcoming Plan Commission public hearings for the next phase of the ongoing Allen County – Fort Wayne Zoning Ordinance Update project. As you know, the primary objective of this project is to update and align the Fort Wayne and Allen County zoning ordinances. This project is part of ongoing work to improve, clarify, simplify, and streamline the community’s development and permitting processes.
During Clarion Associates work on the community’s replacement zoning ordinances, DPS consultant Don Elliott consistently brought up the fact that once the ordinances were adopted and used by the community and by staff, there would be issues that would come up with the language, or it would be determined that there would be items that had been missed, or misspellings and similar errors in the documents would be found.
That has proven to be the case, as staff has continued to identify non-substantive issues and items to be addressed since the last technical ordinance amendments became effective.

This set of technical amendments is proposed to:
1) Clarify language that is not clear based on the use of the ordinances so far;
2) Address issues that have come up since the effective date of the replacement ordinances (4/5/2014) or the effective date of the last technical amendment (1/1/2016);

The proposed amendments are listed in a summary and shown in redlined versions of the ordinances that have been posted on the DPS website. The summary shows which pages will be affected in each ordinance. For the most part, these amendments will be made to both the Fort Wayne and Allen County zoning ordinances; the summary indicates which amendments will affect only one ordinance.

The Fort Wayne Plan Commission will hold a public hearing on these proposed amendments on Monday, October 9th at 6:00 p.m. in Room 035 on the Garden (Basement) Level of the Citizens Square building.

The Allen County Plan Commission will hold a public hearing on these proposed amendments on Thursday, October 12th at 1:00 p.m. in Room 035 on the Garden (Basement) Level of the Citizens Square building. Citizens Square is located at 200 E. Berry Street.

The proposed effective date of these amendments is January 1, 2018. To maintain alignment with the County and Fort Wayne, the Town of Huntertown ordinance will also be amended as part of this project.
